5310 Funding FAQs - Under federal transit law (49 U.S.C. § 5331), public transportation operations that receive financial assistance under the FTA’s Formula Grants for the Enhanced Mobility of Seniors and Individuals with Disabilities (§ 5310) in addition to Urbanized Area (§ 5307), Capital Investment Grant (§ 5309) and Rural Area (§ 5311) funds must conduct controlled substance and alcohol testing of public transportation employees responsible for safety-sensitive functions. These FAQs describe the extent to which Section 5310 recipients are subject to the drug and alcohol program rule. February, 2022
